CBD Biosafety Series Compiles Materials on Liability and Redress

The third issue of the CBD Biosafety Technical Series reviews information gathered during the negotiation of the Nagoya-Kuala Lumpur Supplementary Protocol on Liability and Redress, to inform national processes towards ratification and implementation.

CBDSeptember 2012: The Secretariat of the Convention on Biological Diversity (CBD) has released a compilation of materials prepared during the negotiation of the Nagoya-Kuala Lumpur Supplementary Protocol on Liability and Redress to the Cartagena Protocol on Biosafety (Supplementary Protocol). The compilation is issued as part of the CBD Biosafety Technical Series.

The publication aims to inform national dialogues and action towards ratification and implementation of the Supplementary Protocol, and to serve as a reference for academic work on liability and redress for environmental damage.

The first section covers concepts, functions and elements relevant to liability and redress, including: an overview of the Supplementary Protocol; liability for transboundary environmental damage; functions of international rules on liability and redress; elements commonly considered in elaborating rules and procedures on liability and redress; the concept of damage; and financial security to cover liability.

The second section surveys existing international agreements and practices on liability and redress in other issue areas, such as: damage caused by oil pollution, aircraft, and space objects; and pollution of the marine environment.
