CBD Issues Note on Signing, Ratification of Nagoya-Kuala Lumpur Protocol

28 March 2011: The Secretariat of the Convention on Biological Diversity (CBD) has released an introductory note to prepare for the signature and ratification of the Nagoya-Kuala Lumpur Supplementary Protocol on Liability and Redress to the Cartagena Protocol on Biosafety.

The note provides basic information about the Supplementary Protocol with a view to facilitating signature, ratification, acceptance, approval or accession by States and regional economic integration organizations that are Parties to the Cartagena Protocol on Biosafety. The first section gives an overview of the mandate and the negotiation process of the Supplementary Protocol, followed by an outline of its core approach to addressing damage resulting from living modified organisms (LMOs).

The note also explains the legal obligations to which Parties commit when ratifying the Supplementary Protocol, and the benefits of ratification, including: creating further confidence and an enabling environment for the environmentally sound application of modern biotechnology; creating incentives for operators to ensure the safety of LMOs; and creating further opportunities for cooperation and capacity-building.

The final section explains the necessary steps in signing and ratifying the Supplementary Protocol and options for ratification or accession, including model instruments of: full powers; ratification, acceptance or approval; or accession.
