25 October 2012: The UNFCCC Secretariat has published the recommendation of the Executive Board of the Clean Development Mechanism (CDM) to the Conference of the Parties serving as the meeting of the Parties to the Kyoto Protocol (COP/MOP) regarding a procedure for addressing significant deficiencies in validation, verification or certification reports (FCCC/KP/CMP/2012/11).

The recommendation was provided by the CDM Executive Board in response to the COP/MOP’s request to revise the draft procedure to address significant deficiencies in validation, verification and certification reports, for adoption by the COP/MOP at its eight session. The recommendation describes a draft procedure for assessing and attributing liability for significant deficiencies that are caused by the professional negligence or fraud of a designated operational entity (DOE) and provides a process for correcting such deficiencies.

The recommended procedure prescribes the administrative steps to be followed by DOEs, other stakeholders, the CDM Executive Board, the review team, the Secretariat and the independent review committee when making or responding to a submission identifying potential significant deficiencies in validation, verification or certification reports. It enters into force on 1 January 2013 and will only apply to validation, verification, or certification reports that are submitted on or after this date.
